On July 1, 2017, the transition period ends and the CASL sections that deal with the private right of action will come into force.
July 1, 2017, is a deadline for you to obtain express consent orally or in writing from anyone you have been sending your newsletter since prior to July 1, 2014.
Contacts you have Existing Business Relationship, buyers and sellers under contract, you can send your newsletter up to two years under implied consent. After the two-year period, you will require to obtain express consent orally or in writing.
Contacts you have Existing Business Relationship, listing, buyer & open house inquiry, you can send your newsletter up to six months under implied consent. After the two-year period, you will require to obtain express consent orally or in writing.
If consent cannot be implied, then express consent is necessary for all other contacts.
Express consent means that the recipient has affirmatively indicated to you that they would like to receive your email newsletter in response to a request for consent orally or in writing.
